  • przed ślubem – wtedy zaczyna obowiązywać od dnia zawarcia małżeństwa;
  • The most common reasons why spouses decide to enter into a prenuptial agreement:

    • To protect the assets of one spouse (e.g. from liability for the other spouse’s debts),
    • One spouse running a business,
    • A desire to maintain financial transparency and separate management of assets,
    • Prudent planning of family assets and inheritance,
    • Safeguarding the interests of children from previous relationships.

What are the benefits of separate property?

    • Each spouse retains full control over their own assets – without the other spouse having a say.
    • No liability for the other spouse’s debts, unless otherwise provided for by law.
    • The ability to independently enter into financial commitments, conclude contracts and acquire assets.
    • Simplified settlements in the event of divorce or separation – there is no need to divide joint property.
    • Security and transparency in both personal and business matters.

How do you establish separate property at a notary’s office?

The procedure for drawing up a prenuptial agreement at a notary’s office is simple and quick:

    1. Contact the office – arrange an appointment and provide preliminary information regarding the spouses or fiancés.
    2. Drafting the matrimonial property agreement – in accordance with applicable legislation and the wishes of the parties.
    3. Signing the notarial deed – the document becomes legally binding upon signature by both parties in the presence of the notary.
    4. (Optional) Registering the prenuptial agreement with the relevant authorities – e.g. when updating details in the CEIDG or the land and mortgage register.

    What documents are required?

    • The spouses’ (or future spouses’) identity cards,
    • In the case of a prenuptial agreement – details of the planned wedding,
    • In the case of a prenuptial agreement during marriagethe marriage certificate (this may be provided or obtained by the notary),
    • In some cases – details of any liabilities or agreements between the parties.
