Typowe przypadki to:

  • Umowa sprzedaży nieruchomości – mieszkania, działki, domu
  • Umowa darowizny
  • Umowa majątkowa małżeńska (intercyza)
  • Testament notarialny
  • Umowa spółki z ograniczoną odpowiedzialnością
  • Akt poświadczenia dziedziczenia
  • Umowa deweloperska
  • Umowa przenosząca własność lokalu
  • Podział majątku wspólnego
  • Ustanowienie służebności lub użytkowania
  • In each of these situations, a well-prepared draft allows you to familiarise yourself with the content of the document in advance, consult with the other party or a solicitor, and avoid misunderstandings on the day the deed is signed.

    Why is it important to prepare a draft notarial deed?

    • Accuracy and clarity – the parties can review the wording of the document in advance and raise any comments.
    • Compliance with the law – the notary ensures that the draft deed meets all formal and substantive requirements.
    • Legal certainty – the elimination of risks and ambiguities in the document’s content.
    • Efficient completion of the procedure – on the day the deed is signed, everything is prepared and agreed upon, which shortens the duration of the meeting.

    How is a draft deed prepared at a notary’s office?

    1. Contacting the office – the client approaches the office with a request to draw up a draft for a specific transaction (e.g. the sale of a flat, a gift, or the formation of a company).
    2. Submission of details and documents – including the parties’ details, details of the subject matter of the transaction, extracts from the land and mortgage registers, draft contracts or previous deeds.
    3. Drafting the deed – the office analyses the documents, ascertains the parties’ intentions and prepares the text in accordance with applicable law.
    4. Submission of the draft for approval – the client receives the draft deed by email or in person, and may submit amendments or ask questions.
    5. Arranging a date for signing the deed – once the draft has been approved, a date is set for the final signing at the law firm.

    Is it possible to commission a draft deed without being obliged to sign it?

    Karolina Adam’s notary’s office in Gdynia also offers the option of ordering the draft notarial deed itself – without any obligation to proceed with the notarial procedure. This is useful, for example, in the following situations:

    • preparing documentation for contract negotiations,
    • to obtain a lawyer’s opinion,
    • familiarising yourself with the potential consequences of the transaction before it is concluded.

    This solution allows you to approach important financial or legal decisions with full awareness, without time pressure.

    PRICE LIST FOR NOTARIAL SERVICES

    Not all the fees charged by a notary constitute their remuneration. The final cost of specific legal procedures is also affected by court fees and taxes.

    The fees charged by notaries include, amongst other things:

    • a court fee in accordance with the Act of 28 July 2005 on costs in civil cases;
    • tax on civil-law transactions in accordance with the Act of 9 September 2000 on Tax on Civil-Law Transactions;
    • inheritance and gift tax in accordance with the Act of 28 July 1983 on Inheritance and Gift Tax;
    • notarial fees, the amount of which is regulated by the Regulation of the Minister of Justice of 28 June 2004 on maximum notarial fee rates;
    • value added tax at a rate of 23 per cent on the notarial fee charged.

    Usually, information on the estimated costs of a notarial procedure can be obtained by telephone, but specific costs can only be quoted once all the necessary documents have been submitted.
