Na czym polega sporządzanie wypisów, odpisów i wyciągów?

W ramach swojej działalności notariusz uprawniony jest do sporządzania wypisów, odpisów i wyciągów z aktów notarialnych oraz innych dokumentów znajdujących się w kancelarii. Dokumenty te mają charakter urzędowy i mogą być używane w obrocie prawnym na równi z oryginałem – np. w sądach, urzędach, bankach lub w kontaktach z innymi osobami.

Czym różnią się wypis, odpis i wyciąg?

  • Wypis aktu notarialnego – jest to wierna kopia oryginału aktu notarialnego, opatrzona podpisem notariusza i jego pieczęcią. Posiada taką samą moc prawną jak oryginał i może być przedstawiany instytucjom jako dokument urzędowy.
  • Odpis dokumentu – może dotyczyć zarówno aktu notarialnego, jak i innych dokumentów (np. testamentu, pełnomocnictwa). Jest to dosłowne odwzorowanie tekstu, poświadczone przez notariusza.
  • Wyciąg z dokumentu – zawiera tylko wybrane fragmenty dokumentu, istotne z punktu widzenia klienta lub konkretnego postępowania (np. sądowego). Notariusz poświadcza zgodność wyciągu z oryginałem.
  • When are extracts, copies and statements required?

    • When submitting documents to public authorities (e.g. an extract from a deed of gift to the Tax Office),
    • For entries in land registers,
    • In court, probate or administrative proceedings,
    • For the other party to a notarial transaction, when the original remains at the notary’s office,
    • In the event of the loss of the original copy, in accordance with the rules laid down by law,
    • In the case of powers of attorney – copies are required by banks, government offices and business partners.

    Who is entitled to receive an extract or a copy of a notarial deed?

    Access to notarial deeds is strictly regulated. An extract or copy of a notarial deed may be obtained by:

    • a person who took part in the transaction,
    • the heirs of a person who was a party to the deed,

    • a person named in a will,
    • courts, public prosecutors’ offices and other authorised institutions,
    • other persons – only with the consent of the parties or on the basis of a power of attorney.

    How do I obtain an extract or a copy of a document from a notary’s office?

      1. Contact the office – by telephone, email or in person.
      2. Verification of identity and authorisation to access the document – necessary to maintain notarial confidentiality.
      3. Preparation of an extract, copy or summary – the document contains the relevant clauses and the notary’s signature.

      4. Collection in person or dispatch of the document – according to the client’s preference.

    Does an extract have the same legal force as the original?

    Yes. An extract from a notarial deed drawn up by a notary has the same legal force as the original. It may therefore serve as the basis for:

    • making an entry in the land register,
    • disposing of the property,
    • asserting inheritance rights,
    • executing testamentary dispositions,
    • confirming a power of attorney.

    PRICE LIST FOR NOTARIAL SERVICES

    Not all the fees payable to a notary constitute their remuneration. The final cost of specific legal procedures is also affected by court fees and taxes.

    The fees charged by notaries include, amongst other things:

    • a court fee in accordance with the Act of 28 July 2005 on costs in civil cases;
    • tax on civil-law transactions in accordance with the Act of 9 September 2000 on Tax on Civil-Law Transactions;
    • inheritance and gift tax in accordance with the Act of 28 July 1983 on Inheritance and Gift Tax;
    • notarial fees, the amount of which is regulated by the Regulation of the Minister of Justice of 28 June 2004 on maximum notarial fee rates;
    • value added tax at a rate of 23 per cent of the notarial fee charged.

    Usually, information on the estimated costs of a notarial procedure can be obtained by telephone, but specific costs can only be quoted once all the necessary documents have been submitted.
